1. Acceptance of Terms

By accessing or using CxScript Pro ("the Service"), operated by Four Knots Consulting, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

CxScript Pro is a commissioning test script generation platform designed for data center professionals. The Service allows users to define project scopes, input design parameters, and generate commissioning test scripts using AI-assisted workflows. The Service is provided on a subscription basis.

3. Account Responsibilities

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must promptly notify us of any unauthorized use of your account.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old and have the authority to enter into these terms on behalf of yourself or your organization.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service to generate content that is harmful, fraudulent, or misleading.
• Share your account credentials with unauthorized third parties.

5. Intellectual Property

Your Content: You retain full ownership of all data, project information, and test scripts you create using the Service. We do not claim any intellectual property rights over your content.

Our Service: The CxScript Pro platform, including its design, code, features, and documentation, is the intellectual property of Four Knots Consulting, LLC. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.

6. Payment Terms

• Payments are processed through Stripe. By subscribing, you agree to Stripe's terms of service.
• Subscriptions are billed on a recurring basis according to your selected plan (monthly or annual).
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• Refunds are handled on a case-by-case basis. Contact us for refund requests.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any price change affects their account.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. No Service Level Agreement (SLA) is provided for the current tier. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

8. Limitation of Liability

To the maximum extent permitted by law, Four Knots Consulting, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

The test scripts generated by the Service are intended as a starting point and must be reviewed and validated by qualified commissioning professionals before use.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days following termination, after which it will be deleted.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Florida.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised terms.
